A registration of a trademark offers to its holder the right to prevent that third use similar trademarks to confuse the consumer. However the law obliges to the holder of a trademark to exercise said right presenting timely oppositions againsts the similar trademarks. If the holder of a mark registered not is aware of that a third is applying for a trademark that violates his rights, the holder hardly will present opposition to prevent the grant of the confusing trademark. This circumstance obliges registered trademark owners to hire a monitoring services.
